Class 7 license holder working at another location.
Not sure I even now the right terminology to use in asking this.
I have a friend who has just gotten a class7 license. He is needing to get another lathe set up and is looking for one- which will take time and delay his work.
I was wondering if it is legal for him to do work using equipment at a location other than the business location, if the work remained in his possession.
For example- could he legally bring his barrel, action, etc, to my location (not a business and no FFL), use my equipment to machine it, then take it back to his location.
Nothing would be out of his possesion or have any work done by anyone else.

In a word NO. Tell your friend to go read the BATF FAQ's. It's a small point, but BIG to them.

Thanks for the answer. The question was mine. He indicated his understanding was that he could not. I wanted to double check.

could you maybe find a link to the particular faq with this information. i can't find it. i didn't think that it mattered where the manufacture did the work as long as he is the one doing the work.

It is my understanding the licensed premises is where you do the transfer, After that you can do the work where you like. Would love to see the faq also.

Your opinion is incorrect according to the three ATF agents I have worked with. I have an 07 Manufacturers license.
Your friend can in point of fact work on the firearms anywhere. They cannot leave his "possession" and must be returned to the license premise every evening. Now, I would not do this without notifying and confirming with his agent prior to doing it.
Of course, you do not know me from anyone. I am not a lawyer, and really my statement will not do you a bit of good in a court of law. However I wanted to input my experience as to help your friend.

Understood, but they are very specific on what can and can't be done away. Very fine line and asking your local ATF is the BEST answer as you can get varying answers. Point well taken and I apologize if I generalized things.

Actually from the FAQs the answer is "yes you may make immediate repairs at locations other than his or her place of business"

It is always best to use written communications with the ATF so you have a physical piece of evidence showing what they told you. Phone calls and face to face talk is of little value unless both parties agree on what was said, which would be unlikely if the ATF was prosecuting you.

Come on guys think about this. Has anyone ever been to a trap or sporting clays shoot or gun show for that matter? Vendors/gunsmiths set up a make repairs and mods all the time and guns are transferred at gunshows all the time location doesn't matter as long as it's noted. I will read my book to make sure but as far as I remember it what you are asking aboutbis perfectly legal.

It is my understanding and I have an 07FFL that you can make repairs anywhere but I am not sure about actually building firearms. If your friend is an 07 ffl then the question is he repairing or manufacturing? I think the ATF will look at the difference between the two function. I was going to buy another machine shop and do work at both places and It was my understanding that I would have to license both to be legal. You might inquire about a temporary variance which the ATF might grant to help your friend out.
