I couldn't find the previous thread where we discussed that today you are a criminal regardless of your best intentions. There are so many governmental agencies creating "policy" and "rules" that there is no way you can know and comply with them all. We also discussed that your ignorance, or lack of knowledge of the law, does not prevent you from being a criminal.

I received notification today, that for the last 12 years, my business has been breaking state law by not reporting "Unclaimed Funds" yearly to the state. It would stand to reason that an organization requiring my participation would notify me when I created that business. Nothing done through coercion is reasonable.

So here is your reminder, if you are in the state of Ohio, "All businesses that operate in the state of Ohio" you are required by law to file.

"The company may incur two (2) civil penalties of $100/day and criminal penalties of up to $500/day for failure to report..."

A) call your attorney.
B) without getting "political" - no matter who is in the chair, the unelected faceless bureaucrats are the ones that run the show. They don't like the middle class or small business and they show it.

I wonder does the state think Fal is a bank?

My first thought was that this did not apply to me, after looking online at their provided information, there are very few and very limited exclusions. That quote above, "All businesses that operate in the state of Ohio", is from their guidance.
Unclaimed funds?

Is this sales tax related?

I'm not familiar with that term.

Unclaimed funds can be from a variety of sources.

They want uncashed checks to be handed over? Don't those just void after three months? Just shred it and the person keeps their money.

Funny- in my state, all you have to do is call up the State Department of Revenue, and they will talk you thru all this stuff on the phone. We accidentally overpaid some sales tax last year, and when we called, we had a refund check in the mailbox within a week, and when my wife was on the phone with them, they actually tried to figure out how to recategorize our business to save us taxes. They also assign workmens comp codes for the type of work our employees do, and, again, on the phone, the state employee worked extensively with me to find the least expensive and best suited category.
So-

Have you called up and asked about this, or are you just fuming at home?

Funny how that works.

Everytime I forget to file Sales tax info, I get my resale certificate suspended and then I get a very pleasant call from a lady, who bends over backwards to get me back on track. No threats of fines, garnishment,imprisonment, dismemberment etc etc. I almost look forward to the occasional call because we have quite pleasent convo's about life,weather,family etc etc.

Maybe that's how pinko commie states work? Work with the populace rather then hammering them into the ground.

they dont suspend mine, they just send me an email. And usually the reason I forget because I have no business, in which case, there is no penalty.
( I tend to do a few big jobs, and often dont see income for months at a time)

You really didn't read my post did you? I didn't over pay on sales tax. No I have not "called up" about this, per the advice of my lawyer.

Don't take my guidance on this for obvious reasons, but this sounds an awful like someone has misinterpreted this (not implying that it's you, either). Some years back, my younger brother and I both received communication from the state of Illinois (we grew up there) about unclaimed funds. The amounts weren't large (I think it might have been a couple of hundred bucks in a long-forgotten bank account from when were kids). I don't think I even bothered to submit a claim (can't recall if I could provide proof of an old address, or something else...it was 30 years old at that time).

Are you certain that it isn't something like this? Sure, maybe the law is written to compel all businesses to file this form, but I've gotta wonder if that just means you get to submit this form once per year (stating that you are not holding unclaimed funds). I'm not a fan of unnecessary paperwork either, but sometimes it just comes with the territory.

I'm sure your lawyer would prefer your business than for you to resolve it. I also know that beauracrats that can sit at a desk and search the web for non-compliance seem to find particular delight in hunting down even the most remote possible violation. Politicians put laws in place thinking they are going after banks and large businesses and impose crap on single owner and small businesses. I once got a notice that we were being fined for not complying with Georgia's horse boarding facility inspection process. I called and they informed me that since we were offering breeding services we were considered a boarding facility. I wrote a certified letter, with a copy of the one ad I'd place in a non-profit website, offering "shipped semen", stating clearly that the state department of agriculture should understand that does not imply any outside horses onsite. I received a short reply notifying me that was true and the case was dropped. But obviously somebody was patroling the web ...

By law I'm required to spray round-up on certain invasive grasses.

This is why nobody ever leaves California to go to some hell hole like Ohio.

A friend left CA for PA, after a winter in PA, left for FL, after a summer in FL is on the way back to CA.

Course my electric works, my wife can water her plants whenever and however she wants, and a million other things. I've lived all over the US, from weeks, to months, to years, but wound up back here in boring dumb Ohio. They just hope someday to grow up to be as fascist as California.
