    In Queensland ,you cant cut anyone out of your will,who is related to you by birth or relationship.......this means all the cranky old gits cant have any nasty surprises left after they go.......First in line is the relationship survivor,next any dependant children,after that the estate is divided among children and grandchildren........you cant cut anyone on this list out of your will,nor can you do something nasty like leaving a spouse a life interest in a falling down house ,with no provision for maintenance costs.......Even giving away assets pre decease may be overturned if there is malicious intent or undue influence by a third party.

    That must be disappointing as over here people keep lawyers busy and cut and paste names every time they get mad.

    John K. ,ignoring political posts after, in the USA you are advised to mention each and every child, ex spouse, etc if you intend to cut them out of the inheritance. If you just say it all goes to .... your hateful drunk brother will say he just forgot to mention me and I deserve a share.
    I can say in the USA if a adult child dies with no will, no children or wife his estate goes to his parents. My mother had enough money and refused the estate and it was shared among his siblings.
    Any debts incurred after death such as burial costs legally get paid before any debts from before death. That makes sure burial is taken care of even if the finances are unsure until after the services are complete. They know they will be paid first regardless of anything in the will.
