    Sounds like it was due to the company not following it's own posted policy?

    Oh oh,

    Sounds like a BOHICA event for employers. If they can start issuing fines for workers who contract an illness and have a bad outcome they can collect millions in additional revenue.

    $9,557 in penalties may sound severe, but for any thriving business it's likely cheaper than the legal costs of contesting the issue and risking future "special attention" from the feds. The article states that they have two facilities and this one alone cost $7 million dollars.

    It should be obvious that, short of extensive DNA testing and contract tracing, it's impossible to actually prove that the employee got infected at work rather than in his outside activities. We now know that a positive test result is not proof of infection and even if it were there is always the possibility that all the positive employees contracted it at an area business such as a bar, sandwich shop, convenience store, etc.

    But once again we see the overreach of authorities and the extension of "Covid" as a new foot in the door for outfits like OSHA.

    They go to the U.S. Treasury general fund.

    However, agencies that deliver large amounts of "revenue" tend to get more favorable treatment of budget requests so it's not totally without self-interest.

    Sounds kind of like a company getting fined when someone loses an eye from not wearing safety glasses. It isn't enough to just have a sign at the entrance saying that you need safety glasses. It needs to be enforced.

    I do think it is kind of a slippery slope figuring out who gave them the Covid though.

    And I for one am very glad that we have OSHA. I can only imagine the working world without them.

    We've been in what is called "community transmission" since late 2019 or very early 2020. By definition, it is impossible to perform reliable contact tracing at this point. A $10k fine is chump change, though. Sounds like OSHA wanted to make an example but didn't want to risk court.

    Hribar is a very large company. Is it possible some kind of civil suit from the family, if any, will result from the OSHA violation?

    It's hard to believe that many business's could possibly be in the same situation.

    Here in Australia if one of our staff members passes covid onto a visitor to our workplace eg a courier, and the business they work for loses money from it eg. and enforced shutdown, we can be liable for the loss. It hasn't been tried in court yet, but all the business groups are saying it could happen.

    Umm, aren't these fines issued as a pr stunt? Negotiated down later?

    And as for company policy, precautions, and enforcement.... good luck. My job has policies. But from my experience almost absolutely zero enforcement. So if companies don't enforce the rules and they know it's going on let them get kicked.

    After the disclaimer, this shit is totally out of hand, people need to start using some common sense. I know I know it is in short supply.
    I have 20+ years expiernce and education biology and medicine. To me this not a politcal issue (although it has been made one) but common sense. Listen to the doctors and scientists. It is a small inconvience to wear a mask when in public places, wash your hands frequetly.
    It is a numbers game, if mine comes up then personally I am glad to have recieved a vaccine, it may make me sick but will most likey kee me out of the ICU and off a vent.
    I try and follow my knoweledge of medicine and the recomendations of the CDC to stack the odds my favor. Granted I spent 5 days sedated on a ventilator 9 years ago for pneumonia and have scared lungs plus I smoke a lot.
    I just do not understand why there is such push back on the vaccine and to wear a mask when indicated.
    This OSHA thing is of our own creation-Society is sick the average person is so naive. Just listen to the morning news & what comes out the mouths of avaerage citizens when interviewed on almost anything, mass shootings, pandemic, hit and runs ect.
    We really need to start taking accountability for our actions and quit looking for the free lunch.
    My brother inlaw is Trumper and anti vacc / mask. Who is suffering his daughters are.
    We should be pulling together and putting petty differences aside for all our sakes, but most importantly the next generation, I will even touch what we are doing to the planet and certain species.

    Come on, wake the fuck up.

    Such a large part of the population are like when your children turn 18+, but still live at home.

    They want to be "adults" when it's convenient only.

    They want to be free to make their own decisions without boundaries, but don't want to be financially/legally responsible for themselves/their decisions. You can't have it both ways.

    Does a business have to follow each employee around like a toddler and make sure they are wearing safety glasses? Jesus...

    FTW has never been so relevant.

    Question: Do they get compensation if an employee gets influenza from your workplace and they lose several weeks due to a severe case?
